Thanks for your question - artist have the option to disable the embed code for their content, i.e. if they haven't done so, you're free to go ahead and embed the track or playlist.
If the content is removed from, or made private on SoundCloud, the embedded player would still load, however instead of the track your visitors would see an error message, informing them that the content has disappeared. You can test this by uploading a brief recording on your own SoundCloud account, mess around with the embed code on http://htmledit.squarefree.com/ for instance, see what happens when you change the settings, etc. :)
